Misdemeanor Assault In Arizona

Assault Defense Attorney

Crimes where victims are involved are taken very serious by the police, prosecution and the Arizona Criminal Justice system. Even if you have a clean criminal record you still face probation, counseling, jail or even prison with a felony assault conviction in Arizona. James Novak, Assault defense attorney understands what it takes to provide a strong assault defense to the allegations that you assaulted another person. Some of these defenses may include for example, that you had been defending yourself or someone else; you were not present; the other party committed the assault on you; or simply that you did not commit the assault.

Arizona Laws – Assault

The Arizona assault laws are broad and include a wide range of categories for which you may be charged and convicted under the heading of assault.

Under A.R.S. 13-1203. Assault a person commits assault by:

  1. Intentionally, knowingly or recklessly Causing any physical injury to another person; or
  2. Intentionally placing another person in reasonable apprehension of imminent physical injury; or
  3. Knowingly touching another person with the intent to injure, insult or provoke such person.

The laws are general enough that the prosecutor will seek to convict you if there are any signs of injury to another including slight bruising or redness on the alleged victim’s body. Under “number 3.” slightly pushing or any touching may lead to an assault if the other person is insulted or provoked to act. Even if the other person was not in fact touched, but believes you may harm them, then you may still be convicted of misdemeanor assault.

Assault Penalties

A conviction for assault in Arizona includes sentencing such as probation, counseling, community service, fines, restitution, and jail. Some not so immediate consequences of an assault conviction may affect your school and current or future job opportunities.
