Of all Field Sobriety Tests (FST) there are only three “Standardized Field Sobriety Tests (SFST)” approved by the National Highway Traffic Safety Administration (NHTSA); Medical Science; or other Arizona governing entity for DUI Roadside Testing. SFTSs are preliminary DUI tests administered by police following a DUI stop of a driver suspected of DUI, DWI, or driving “impaired to the slightest degree”. FSTs were developed to be used as a tool to assist police offers in preliminary detection of DUI, DWI, and Drunk Driving investigations. The Police officers must be formally trained and accredited to administer Standard Field Sobriety Tests. These are intended to be used as preliminary tests only and are done in addition to a DUI breath or blood test. In order to administer the tests, the police must have your voluntary consent (not to be confused with DUI blood or chemical test which may be required.). FSTs are not required and only serve to strengthen the prosecution’s case against you. The police give you instructions on how to take the FST; grade you on the FST performance test; and then report on the results using a point system. If the suspect “fails” the test as judged by the police, the police will proceed to the next stage of DUI investigation which includes either a DUI breath test; Drug or DUI blood test or both.
