Felony Theft Penalties and Sentencing Chart in Arizona

A. First – time offense Felony Theft

The statutory provided penalties for felony theft (non-dangerous) crimes for a first-time offender convictions are referenced under A.R.S. § 13-702:

  • Class 6 felony theft: prison terms ranging from six months to 18 months. The presumptive sentence for a first offender is one year.
  • Class 5 felony theft: prison terms ranging from nine months to two years. The presumptive sentence for a first offender is 1.5 years.
  • Class 4 felony theft: prison terms ranging from 18 months to three years. The presumptive sentence for a first offender is 2.5 years.
  • Class 3 felony theft: prison terms ranging from 30 months to seven years. The presumptive sentence for a first offender is 3.5 years.
  • Class 2 felony theft: Prison terms ranging from four to ten years. The presumptive sentence for a first offender is five years.

Convictions for theft offenses in Arizona may also result in restitution; fees; assessments; and required participation in shoplifting counseling; and Felony theft fines of up to $150,000.

B. Repeat Felony Theft Offense

The statutory provided penalties for felony theft (non-dangerous) crimes for repeat offenders are referenced can categorized under A.R.S. § 13-703 (H), (I), (J):

A.R.S. § 13-703 (H) Mitigated to *Aggravated Sentencing:

Class 6: Prison terms 33 to 2 years;

Class 5: Prison terms .5 to 2.5 years;

Class 4: Prison terms 1.1 to 3.75 years;

Class 3: Prison terms 1.8 to 8.75 years;

Class 2: Prison Terms 3 to 12.5 years

A.R.S. § 13-703 (I) Mitigated to *Aggravated Sentencing:

Class 6: Prison terms .75 to 2.75 years;

Class 5: Prison terms 1.0 to 3.75 years;

Class 4: Prison terms 2.25 to 7.5 years;

Class 3: Prison terms 3.3 to 16.25 years;

Class 2: Prison Terms: 4.5 to 23.1 years;

Class 6: Prison terms 2.25 to 5.75 years;

Class 3: Prison terms 7.5 to 25 years;

Class 2: Prison Terms: 10.5 to 35 years;
