Arizona Drug Laws – Sentencing for First Time and Repeat Offenders
Many drug offenses are considered felonies, especially if the charge for a repeat offense. Eligible first time offenders may be eligible for a drug diversion program offered in Phoenix AZ called TASC. The defendant must meet certain qualifications to be allowed into the program. It must be agreed upon by the court, prosecution, and Arizona TASC. If retained, the Law Office of James Novak, will defend your charges. If the charges cannot be dismissed, the next step would be to help clients qualify to be allowed into the diversion program as an alternative to jail or other penalties.
If you are accused of possessing a significant amount of illegal drugs; charged with a felony drug offense; have a prior criminal record; or convicted of a repeat drug crime, you may be exposed to jail or prison sentencing. In such cases, you generally would not be eligible for a drug diversion program. If you are convicted of drug possession charges in Arizona, the penalties will fall within a particular sentencing range, from mitigated (less severe penalties) to aggravated (higher/severe penalties). Depending on the many factors prison terms can range from one year to 20 years or more for a Class 2 felony, large fines and fees; and other harsh penalties.
